Two individuals from Brooklyn, identified by prosecutors as members of a violent street gang, have been handed lengthy prison sentences after being convicted in the tragic shooting death of a 1-year-old boy in July 2020. The incident occurred during a nighttime cookout, where the young child was struck by a stray bullet while in his stroller.

Dashawn Austin, one of the perpetrators, was found guilty of second-degree murder in the killing of the boy, Davell Gardner. The 28-year-old resident of Canarsie was sentenced to 50 years to life in prison by Justice Danny Chun of State Supreme Court in Brooklyn. Akeem Artis, the second man involved, was sentenced to 40 years in prison by Justice Chun. Artis, aged 27 and hailing from Bedford-Stuyvesant, was convicted of first-degree manslaughter and other charges in connection with the toddler’s death.

Eric Gonzalez, the Brooklyn district attorney, expressed his sorrow over the tragic loss, stating, “Little Davell never got to celebrate his second birthday. My heart breaks for his mother and father and all the families and victims affected by such devastating gun violence.”

Impact of Gun Violence Surge

The fatal shooting at the cookout was part of a surge in gun violence that occurred in New York and throughout the United States during the pandemic-affected summer of 2020. Prosecutors revealed that Austin and Artis were affiliated with the Hoolies street gang, which laid claim to the area around a public housing complex in Bedford-Stuyvesant as their territory. The shooting that resulted in Davell’s death was said to have occurred during a clash with a rival gang.

According to prosecutors, Austin was observed entering the passenger seat of a vehicle driven by Artis, which then turned onto a street near the Raymond Bush Playground where the cookout was taking place. Austin was seen discharging a firearm into the park, striking the young boy and three other individuals. In addition to the charges related to Davell’s killing, Austin was convicted of three counts of second-degree attempted murder in the same incident, as well as second-degree murder in the slaying of a rival at a Brooklyn lounge in March 2020.

Two other individuals identified as Hoolies members, Jayquan Lane and Travis Scott, were also convicted last month of second-degree murder. Lane was convicted in the lounge killing, while Scott was found guilty in the fatal shooting of another gang rival in December 2018.

Further Sentences

Justice Chun sentenced Scott, aged 36 from Bedford-Stuyvesant, to 40 years in prison. The sentencing for Lane, aged 31 from Bedford-Stuyvesant, has been postponed until next month.
