In a recent development in a case stemming from a fatal shooting that occurred during a roadside altercation in 2021, 20-year-old Nickolas James Ammann has entered a plea of voluntary manslaughter. The incident, which took place on West Sunnyoaks Avenue in Campbell, resulted in the death of 42-year-old Greg Cirimele.

The plea agreement was reached between Ammann and the Santa Clara County District Attorney’s Office, with the prosecution expressing doubts about the likelihood of a murder conviction at trial. The plea was entered on Feb. 14 in a San Jose courtroom, pending final approval from a judge at a sentencing hearing scheduled for March 20.

If approved, Ammann will face a nine-year prison sentence, taking into account the time he has already spent in county jail. He would be eligible for parole after serving around five years behind bars.

According to a probable cause affidavit filed by Campbell police and later confirmed during a preliminary hearing, an eyewitness observed Cirimele engaging in a physical altercation with Ammann, who was seated in a blue Saturn in the middle of the road. The witness reported seeing Cirimele approach the driver’s side of the vehicle and begin punching the driver through the window.

Subsequently, Ammann fired several shots at Cirimele, hitting him twice in the chest, before fleeing the scene. Further investigation revealed that the altercation may have been triggered by Cirimele’s attempts to confront Ammann about his driving behaviour on the street.

Despite the judge finding probable cause for the murder charge to move forward, the court acknowledged the presence of evidence supporting a self-defence argument in Ammann’s case. This factor played a significant role in the decision to pursue a voluntary manslaughter plea.

At the plea hearing, Cirimele’s family and friends voiced their objections to the leniency of the agreement, particularly in light of the unlawful possession of a firearm by Ammann. While the victim’s family did not provide a comment in response to inquiries, Deputy District Attorney Carolyn Malinsky acknowledged their concerns.

Malinsky highlighted the complexity of the case, citing witness testimony and video evidence showing Cirimele’s aggressive behaviour towards Ammann prior to the shooting. The plea deal includes six years for the manslaughter conviction and an additional three years for the use of a firearm.

Addressing the family’s dissatisfaction with the outcome, Malinsky expressed empathy for their pain and frustration, emphasising the importance of reaching a fair resolution based on the available evidence and legal standards.

Ammann’s defence attorney, Lindsey Dazel, echoed Malinsky’s sentiments, stating that the plea agreement represents a fair and just resolution given the circumstances of the case.
