EAST WINDSOR, NJ — A manslaughter charge against a 23-year-old East Windsor man in his father’s death has been dropped, and he is now charged with aggravated assault, Mercer County authorities confirm.

Yu Chavarria, a 23-year-old resident of East Windsor, was initially charged with second-degree manslaughter in connection with the death of his father, Edgar Chavarria, aged 58, on January 25.

However, on January 30, a Superior Court judge dismissed the manslaughter charge, and Yu Chavarria is now facing charges of aggravated assault, as confirmed by the Mercer County Prosecutor’s Office on Thursday.

Casey DeBlasio, the spokesperson for the Mercer County Prosecutor’s Office, stated that the manslaughter charge was dropped due to “new information and further investigation.” However, no further details were provided regarding the nature of this new information.

DeBlasio confirmed these developments in response to an article published on NJ.com.

Additionally, DeBlasio revealed that Chavarria has been released and will await future court proceedings.

The incident leading to the charges took place on January 25 when the East Windsor Police responded to a report of an unconscious male at a residence on Twin Rivers Drive North at around 7 a.m., according to a previous Patch article.

Upon arrival, the officers discovered 58-year-old Edgar Chavarria, bleeding from the head and face, lying on the kitchen floor. Tragically, he was pronounced dead at the scene.

According to the ongoing investigation, it was revealed that a verbal argument between father and son escalated into a physical altercation. Yu Chavarria allegedly struck his father multiple times in the face using his fists and head, as stated by Mercer County Prosecutor Angelo J. Onofri.

According to an affidavit obtained by Patch, Yu and Edgar Chavarria rented a basement space in the East Windsor house but had access to two other floors in the residence.

Based on the affidavit, Yu Chavarria recounted that the argument began around 6:50 a.m. on January 25 when his father became upset with him for spending too much time in the bathroom.

“He stated that after the verbal argument, he began washing dishes when his father told him to be quiet and that he wanted Yu to leave the residence,” the affidavit stated.

Yu Chavarria responded with profanity, and in turn, his father allegedly kicked him in the ribs. This led to a physical altercation where Yu Chavarria admitted to striking his father in the face with his fists multiple times and headbutting him in the side of the face, according to the affidavit.

The affidavit further revealed that Yu Chavarria pushed Edgar away and left the residence. As he was leaving, he claimed that his father was still standing in the kitchen.

Yu Chavarria then sought refuge at the Mercer County Library until he was located by detectives as part of the investigation.

The investigation into this tragic incident was undertaken by the Mercer County Homicide Task Force and the East Windsor Township Police Department, with specific involvement from MCHTF Detective Tim Bruey and East Windsor Detective Joe Zucchero.
