West Allis, Wis. – A Milwaukee County judge has handed down a five-year prison sentence, along with an additional five years of extended supervision, to Jose Gaeta Huerta in connection with a stabbing incident that occurred in West Allis in March 2022.
Gaeta Huerta pleaded guilty to an amended charge of first-degree reckless injury in December. The prosecutor’s motion resulted in the dismissal of a second charge of first-degree recklessly endangering safety.
Case Details
According to prosecutors, Gaeta Huerta was accused of stabbing a 41-year-old West Allis man near 70th and Becher on March 2, 2022. The victim was in his backyard testing power tools when he noticed Gaeta Huerta walking back and forth in the alley. Concerned, the victim approached Gaeta Huerta and asked if he needed any assistance. Gaeta Huerta claimed he was just passing by and did not require any help.
Unbeknownst to the victim, Gaeta Huerta had malicious intentions. While the victim continued working, Gaeta Huerta attempted to stab him. A struggle ensued, resulting in further injuries to the victim. Eventually, the victim managed to free himself, and Gaeta Huerta fled the scene.
The victim was taken to the hospital for treatment and was expected to survive. Despite fleeing before the arrival of the police, Gaeta Huerta left behind several distinct identifiers, including a yellow jacket and face tattoos. This led to multiple tips from eyewitnesses, which helped the investigation.
One tip placed Gaeta Huerta at a gas station near 76th and Lincoln, prompting a police response. A detective spotted Gaeta Huerta and ordered him to “get on the ground.” However, Gaeta Huerta attempted to escape and ran off. Police established a perimeter and eventually found him hiding near 74th and Grant, a few blocks away from the gas station. He was apprehended and initially provided investigators with a false name.
This sentencing brings closure to the West Allis community, ensuring that Gaeta Huerta is held accountable for his actions. The victim can now focus on his recovery, knowing that justice has been served.
