WASHINGTON — Recently uncovered video footage from January 6th has revealed a rioter firing a gun into the air outside the Capitol during the attack. The man in question, identified in a previous NBC News story nearly two years ago, appears to be the same individual that online sleuths had identified to the FBI as individual no. 200 on the bureau’s Capitol Violence page three years ago. Videos and photographs captured during the attack showed him with a gun in his waistband, confirming his presence at the scene.

The man, John Emanuel Banuelos, had previously admitted to Salt Lake City police that he was at the Capitol and had been filmed carrying a gun. However, he has not been arrested or charged in connection with the January 6th incident. Instead, Banuelos was arrested in connection with the fatal stabbing of Christopher Thomas Senn in a park on July 4, 2021. Banuelos had expressed his awareness of the potential consequences, stating, “Man, should I just tell the FBI to come get me or what?”

Recently released footage, obtained from another Jan. 6 rioter, shows Banuelos firing the gun into the air twice during the chaos on the west side of the Capitol. Online sleuths, who have been instrumental in aiding hundreds of Jan. 6 prosecutions, also surfaced U.S. Capitol Police surveillance footage that supports their identification of Banuelos as the individual firing the gun. Multiple other videos capturing the gunshots have also been discovered.

This newly released footage is the first evidence of a rioter firing a gun on January 6th. The incident occurred at 2:34 p.m., approximately 10 minutes before Ashli Babbitt was shot and killed by an officer as she attempted to enter the Speaker’s Lobby. The footage of the gunshots outside the Capitol was previously unknown to online sleuths and has never been mentioned in any court filing. The chaotic nature of the situation and the use of non-lethal crowd control munitions by law enforcement officers may explain why the gunshots did not attract much attention at the time.

Contrary to false claims made by conservative media figures, numerous defendants in the Capitol attack were armed with deadly or dangerous weapons, including firearms. The Justice Department has successfully proven in court that several rioters carried firearms during the assault. Examples include Christopher Alberts, who was sentenced to seven years in prison, Mark Mazza, who carried two guns and received a five-year prison sentence, and Guy Reffitt, who was sentenced to seven years in prison after being the first Jan. 6 defendant to go to trial.

Jerod Bargar, another participant in the events of January 6th, dropped his gun in the midst of the mob and was recently sentenced to five years of probation, with six months of home confinement. Prosecutors noted that the officer who recovered Bargar’s weapon was aware of multiple reports of firearms in the crowd. Former President Trump was also aware of the presence of armed individuals among the crowd, as testified by his former aide Cassidy Hutchinson before the Jan. 6 Committee.

Due to the limited number of arrests made on January 6th, it is difficult to determine the exact number of rioters who were carrying guns and other weapons. The newly released footage was made public by Derrick Evans, a Jan. 6 rioter who has admitted to committing a felony on that day and has since been sentenced to three months in federal prison. Evans, a former West Virginia legislator, is currently running for Congress and has been using the video to raise funds for his campaign.
