DAYTON — An Indiana man, Jacob Alan Ashba, 31, of Terre Haute, has pleaded guilty to charges related to a deadly active shooter threat that occurred in June. The incident drew law enforcement from multiple agencies, including five SWAT teams, to a large brick commercial building in Dayton.

Ashba pleaded guilty on Friday in Montgomery County Common Pleas Court to charges of reckless homicide, felonious assault discharge of a firearm on or near prohibited premises, and three counts of tampering with evidence.

The incident took place on June 17 at the Davis-Linden Building located at 400 Linden Ave. Law enforcement officers from various agencies responded to reports of an active shooter threat, which was later updated to a shooting with a suspect inside the building and additional shots fired.

According to 911 call records from the Montgomery County Regional Dispatch Center, multiple witnesses reported a confrontation between two groups of individuals outside the Davis-Linden Building. The situation escalated, with some individuals brandishing baseball bats and engaging in physical altercations. Gunshots were heard, and one caller reported that someone had been shot.

Upon arrival, law enforcement discovered one man, identified as 45-year-old Randy E. Allen of Dayton, deceased and another person injured. The building was subsequently searched by SWAT teams, as captured in video footage obtained from We Do Videos.

The response to the incident involved multiple agencies, including the Montgomery County Sheriff’s Office, Ohio State Highway Patrol, University of Dayton Police, West Carrollton Police, Trotwood Police Department, and the FBI.

Initial arrest of Jacob Alan Ashba occurred in Centerville, but he was released as charges were not filed at that time. Dayton Police Chief Kamren Afzal stated that it was uncommon for a suspect to be released without charges but emphasized the need for further investigation to gather additional evidence.

A grand jury indicted Ashba in August, with the report indicating that the two counts of murder were ignored. As part of his plea agreement, an additional felonious assault count and a misdemeanor charge of obstructing official business were dismissed.

Ashba is currently detained in the Montgomery County Jail and is scheduled for sentencing on February 27.
