Kounkel is facing serious charges, including felony second-degree criminal sexual conduct with a person under the age of 14, two counts of felony harassment with sexual or aggressive intent involving a victim under the age of 18, and a gross misdemeanor charge of criminal sexual conduct with a person under the age of 16. These charges were filed following an incident on March 25, where Kounkel allegedly exposed himself to two girls at a Brainerd business.
Additionally, Kounkel is also facing charges related to a December 5, 2022 incident at the same business, including felony second-degree criminal sexual conduct and felony harassment involving a victim under the age of 18.

During the court hearing, Kounkel appeared via Zoom from a St. Paul treatment facility, accompanied by his public defenders, Mark Hansen and Jacob Clements. The Assistant Crow Wing County attorneys, Candace Prigge and Janine LePage, represented the state in the courtroom.
Previously, Kounkel had requested a new lawyer from the public defender’s office during a hearing in June. However, during the recent hearing, Kounkel confirmed that he would continue to be represented by Hansen. Following a brief recess, Hansen informed the court that Kounkel was willing to accept the plea agreement.
Judge Erik Askegaard instructed Hansen to complete the necessary pre-plea paperwork before the plea agreement could be accepted. Askegaard also mandated Kounkel’s presence in the courtroom during the hearing. Hansen assured the court that he would assist Kounkel in completing the paperwork and coordinate with Kounkel’s family and the treatment facility for arrangements.

On March 25, law enforcement responded to a report of a male exposing himself to two juvenile girls at a Brainerd business before running from the establishment. A witness in the store described the man as wearing a T-shirt, gray shorts, and not wearing underwear. The 16-year-old victim reported that Kounkel was touching himself inappropriately while following her and her sister around the store. Kounkel denied any wrongdoing but was arrested and taken to the Crow Wing County Jail.
The following day, a 12-year-old girl and her mother reported that Kounkel had grabbed the girl inappropriately while they were shopping at the same store. Security footage showed Kounkel following the girl down an aisle and grabbing her around her waist area. The girl quickly moved away from him, and he was seen staring at other young girls in the store.
On April 5, while Kounkel was in jail on charges from the March 25 incident, law enforcement received a report of a sexual assault at the same Brainerd business. The victim, a child, reported that a man had grabbed her buttocks while she was shopping with her mother. The child had previously reported a similar incident in December 2022 but no action was taken at the time.
During an interview at the Family Advocacy Center, the child described the man with a hoodie following her and inappropriately touching her. Kounkel admitted to investigators that he recalled touching at least two juvenile females in the store and running away.
