During a recent hearing, Major Matthew Dickison revealed that he had attempted to utilise New York’s SAFE Act to temporarily confiscate Robert Card’s weapons. However, Dickison abandoned this effort when it became apparent that the law only applied to New York residents. Card, a civilian Army medical contractor from Bowdoin, Maine, was in New York to train West Point cadets when concerns were raised by his fellow reservists regarding his behaviour.

In a surprising turn of events, a civilian Army medical contractor named Patricia Moloney defied a subpoena to appear before an independent commission investigating the circumstances surrounding the shooting. Anne Jordan, the executive director of the commission, disclosed that Moloney declined to testify due to concerns about a potential medical malpractice claim against her. It remains unclear whether this claim is related to the tragic events that transpired in Maine on October 25.

Following Moloney’s absence, the commission temporarily adjourned the session being conducted via Zoom, only to reconvene later with testimony from Major Dickison, who is currently stationed in Korea.

Major Dickison, a nurse practitioner specialising in psychiatry, detailed his interactions with Card during his temporary assignment at Keller Army Hospital. Card had expressed fears of being labelled a pedophile and issued vague threats of taking action against those who were spreading such rumours. Consequently, Card was transferred to a private psychiatric facility for further evaluation and treatment.

Dickison’s recommendations following Card’s hospitalisation, including the confiscation of personal weapons and adherence to healthcare appointments and medication, were relayed to Captain Jeremy Reamer, the leader of Card’s Army Reserve unit. However, Reamer indicated that his authority as commander only extended to drill periods, raising questions about the oversight and management of Card’s situation.

Although Dickison’s actions had been discussed by other witnesses, his testimony before the commission provided crucial insights into the events leading up to the tragic shooting in Maine.

The commission’s investigation has delved into the intricacies of New York’s red flag law and Maine’s yellow flag laws, both of which allow for the seizure of firearms from individuals experiencing psychiatric crises under specific conditions. In a previous interim report issued in March, the commission recommended that law enforcement should have intervened to confiscate Card’s weapons and place him in protective custody under Maine’s yellow flag law.

Despite testimony from Maine police indicating the family’s agreement to remove Card’s guns, the commission criticised the reliance on civilians for such a critical task, emphasising the need for law enforcement to fulfil its responsibilities in such situations.
