The Orange County District Attorney’s office has charged Kelley with special circumstances murder for stabbing five strangers, resulting in the deaths of two men and injuries to three others.

Kelley, 26, is accused of carrying out the violent attack after consuming alcohol and hallucinogenic drugs. In addition to the murder charges, he also faces charges of attempted murder, assault with a deadly weapon, and battery on a police officer. The use of a deadly weapon has been included as a felony enhancement in the case.

The special circumstances murder charges mean that Kelley could potentially face the death penalty or life imprisonment without the possibility of parole. The Orange County District Attorney’s office will convene a special circumstances committee to determine the course of action following the preliminary hearing, where the decision to pursue the death penalty will be made.

The incident took place on the evening of July 4, 2024, as a group of people gathered to watch fireworks near Pecan Avenue and 16th Street in Huntington Beach. Kelley, who had no prior connection to the group, approached them and began stabbing individuals with a knife. Tragically, Eric Hodges, 42, and William Collins, 47, lost their lives as a result of the attack. Two 35-year-old men and a 68-year-old man sustained non-life-threatening injuries.

Several individuals, including a 16-year-old boy, intervened and helped detain Kelley until law enforcement arrived. During his arrest, Kelley allegedly spat on a police officer and used a racial slur. Orange County District Attorney Todd Spitzer condemned the senseless violence, emphasizing the importance of holding Kelley accountable for his actions.

Senior Deputy District Attorney Lexie Elliot of the Homicide Unit is leading the prosecution in this case. Kelley is scheduled to be arraigned in Department C5 at the Central Justice Center in Santa Ana.
