In a bold move to defend her constitutional rights, 19-year-old Serenity Michelle Bushey, along with the owner of Cafe Risque in the Gainesville area, has filed a lawsuit against Florida’s attorney general and two local prosecutors. The legal action aims to halt the enforcement of a recent state law that prohibits adult entertainment establishments from hiring individuals under the age of 21.
The controversial law, which came into effect on Monday, was introduced by Florida lawmakers as a measure to combat human trafficking. However, Bushey and her supporters argue that it infringes upon their First Amendment right to free speech and Fourteenth Amendment right to equal protection under the law.
According to the lawsuit filed in federal court in Tallahassee, Bushey was forced to lose her job at Cafe Risque due to her age, despite being a legal adult. The legal challenge also highlights the impact on other performers aged between 18 and 21 who are now unable to work in adult entertainment venues across the state.
The lawsuit emphasises the artistic nature of adult entertainment and the livelihood it provides for performers like Bushey. It argues that individuals in this industry have a legitimate right to engage in protected speech and expression, which is being stifled by the new law.
Not only does the law affect performers, but it also extends to other employees such as cooks, DJs, waitresses, and security guards aged between 18 and 21. Even third-party contractors hired for maintenance tasks like air-conditioning repairs or carpentry are impacted by the legislation.
In response to the lawsuit, Kylie Mason, communications director for the Office of the Attorney General, stated that the office is prepared to defend the new law once they have been officially served with the legal documents.
