A judge granted Brent Luyster III a mid-range sentence of 7½ years on Wednesday for a December 2022 shoplifting robbery he committed five months after beating a murder charge.
Luyster, now 20, pleaded guilty on June 7 to first-degree robbery and first-degree unlawful possession of a firearm. Charges of second-degree assault and possession of a motor vehicle were dismissed as part of the plea agreement, court records show.

Senior Deputy Prosecutor Dan Gasperino dropped a firearm enhancement on the robbery charge, which would have added six years to Luyster’s sentence, in an effort to consider Luyster’s youthfulness at the time of the crime. However, Gasperino noted Luyster’s multiple prior convictions as a juvenile, including some for robberies with similar circumstances, indicating that juvenile detention did not curb Luyster’s violence.
Prosecutor’s Argument
“We still have Mr. Luyster here today, ramping up his behavior,” Gasperino said, emphasizing the need to keep the community safe. He asked Judge John Fairgrieve to sentence Luyster to the top of his sentencing range.
Defense Attorney’s Plea
Luyster’s defense attorney, Michele Michalek, asked the court to grant Luyster a low-end sentence due to his abusive upbringing in a toxic household. Luyster is the son of convicted triple murderer Brent Luyster, who is serving multiple life sentences without the possibility of release, in addition to 10 years in a federal firearms case.
Michalek argued that a high-end sentence would prevent Luyster from becoming a productive member of society, stating that he has no intention of returning to the gang he was once a part of.
Luyster’s Statement
Luyster expressed remorse for the violence he inflicted on the employees during the robbery and described his tumultuous childhood, which involved substance abuse from a young age. He stated that he is now realizing the wrongs of his upbringing.
“At this point in my life, I don’t know what I want, but I know what I don’t want,” Luyster said. “I don’t want to spend the rest of my life in prison like my father is today.”
Judge’s Decision
Judge Fairgrieve acknowledged that Luyster seems to have matured since his first encounters with the court system. He appreciated Luyster taking responsibility for his actions. The mid-range sentence was deemed appropriate, balancing the severity of the crime and its impact on the victims with Luyster’s youth and unstable family background.
Fairgrieve warned Luyster that any further criminal activities would lead to longer prison sentences, considering his criminal history.
Details of the Shoplifting Robbery
Vancouver police responded to Sportsman’s Warehouse on December 23, 2022, where Luyster and another individual were caught on surveillance video committing a gun accessory theft. The pair entered the store wearing ski masks and gloves, selected items, and attempted to leave without payment.
When confronted by a loss-prevention employee, Luyster pointed a pistol at the employee’s face before fleeing the scene. Outside the store, Luyster fired the pistol into the air, endangering bystanders in the parking lot.
Police later identified Luyster from the surveillance footage and located the stolen vehicle used in the robbery. The stolen car was found parked near Northeast 26th Street and 112th Avenue without license plates.
Luyster’s criminal actions have resulted in a 7½-year prison sentence, emphasizing the consequences of his violent behaviour and the importance of rehabilitation for young offenders.
