The construction area on Mckay Road in Barrie, Ont. where six young adults tragically lost their lives nearly two years ago has been described as a “trap” for motorists. The mother and brothers of Haley Marin, one of the victims, have filed a 3 million dollar lawsuit in connection with the incident.
City of Barrie and Contractors Named in Lawsuit
The lawsuit, filed in March, names the City of Barrie, Condrain Company Limited, Watersand Construction, Erritt Construction, and Shaeffers Consulting Engineers as defendants. Additionally, “John Doe”, the unknown driver of the vehicle involved in the crash, Erin Mitchell (the vehicle owner), and the mother of Jersey Mitchell, another victim, are also listed as defendants. The Alley Nightclub in Barrie is also named in the lawsuit.
Allegations of Negligence
The plaintiffs allege that the death of Haley Marin was a result of the negligence of the defendants. Specifically, they claim that the City and Condrain Company failed to implement necessary safety precautions and did not provide adequate signage or barriers at the construction site. “John Doe” is accused of being an incompetent driver who failed to take appropriate action to avoid the collision. Erin Mitchell is accused of allowing an unfit driver to operate her vehicle, with “John Doe” allegedly impaired by a combination of drugs, alcohol, fatigue, and stress.
Allegations Against Alley Nightclub
The lawsuit also alleges that the Alley Nightclub continued to serve alcohol to “John Doe” despite signs of intoxication, which could have endangered himself and others if he were to drive a vehicle. It is important to note that none of these allegations have been proven in court.
Criminal Charges Dropped
Last September, all criminal charges against Condrain were dropped after new evidence was presented. The legal proceedings surrounding this tragic incident are ongoing, and the families of the victims are seeking justice for their loved ones.
