Last week, a Kingston High School (KHS) student involved in a vicious assault on a classmate in the school cafeteria in May 2023 was handed a six-and-a-half-year prison sentence. Ty’Juan Gray, aged 17, had previously pleaded guilty to second-degree assault in October, opting for the maximum sentence of seven years proposed by Ulster County Judge Bryan Rounds. This decision was made to avoid facing trial for first-degree assault, which carries a potential 25-year prison term.
During the sentencing on June 26, Judge Rounds rejected requests for leniency from Gray’s attorney, the district attorney’s office, and the Ulster County Probation Department. Despite the district attorney recommending a three-year sentence and the probation department proposing six months in prison followed by five years of probation, Judge Rounds deemed the cafeteria assault as “heinous” and declined to grant Gray youthful offender status, which would have sealed his record.
Concerned about Gray’s safety in a maximum-security prison due to his upcoming 18th birthday, Judge Rounds decided to reduce the sentence to six-and-a-half years. He expressed his intention for the sentence to serve justice rather than seeking revenge.
The victim’s mother, Natalie Persad, addressed the court during the sentencing, stating that the assault had forever changed her son’s life, resulting in a permanent traumatic brain injury. Gray’s father left the courtroom during the proceedings, expressing his frustration.

The incident took place on May 3, 2023, when Gray and an unnamed 15-year-old attacked the victim in the KHS cafeteria. Lasting around 18 seconds before school security intervened, the assault left the victim hospitalized with severe injuries. Video footage captured by students showed the 15-year-old kicking the victim’s head while Gray jumped onto him from a cafeteria table.
District attorney Emmanuel Nneji described the video as showing a lack of respect for human life, supporting Judge Rounds’ decision to hand down a significant sentence. The attorney for the victim suggested that the attack was premeditated and involved additional individuals beyond Gray and the 15-year-old.
After undergoing emergency surgery at Westchester Medical Center to address a skull fracture and brain trauma, the victim continues to recover from the physical and emotional impact of the assault. Judge Rounds condemned the violence witnessed in the video, highlighting the need for society to address the normalization of such brutality.
