Late Saturday, a video was released showing a tragic incident in upstate New York where a 13-year-old boy was fatally shot by an officer after he ran from police and pointed a replica handgun at them.

The incident occurred a little after 10 p.m. on Friday in Utica, a city located about 240 miles northwest of Manhattan, during an armed robbery investigation, according to police reports.

The two youths involved in the incident, both 13 years old, matched the descriptions of the robbery suspects and were in the same area at the time of the incident. One of the teens was also walking in the road, which is a violation of state traffic laws.

The body camera footage released by the police shows an officer attempting to pat down the teens to ensure they were not carrying any weapons. One of the teens, identified as Nyah Mway, fled the scene.

The video footage captured the moment when Nyah Mway appeared to point the replica handgun at the pursuing officers, leading to the fatal shooting. The officers believed the replica gun was a real handgun at the time of the incident.

During a struggle on the ground, one of the officers fired a single shot that tragically struck the boy in the chest. Despite immediate first aid efforts, Nyah Mway succumbed to his injuries at Wynn Hospital.

The replica gun carried by Nyah Mway was later identified as a realistic-looking firearm with Glock markings, detachable magazine, and serial numbers. However, it was determined to only fire pellets or BBs.

The officer who fired the fatal shot was identified as Patrick Husnay, a six-year veteran of the agency. Following the incident, Husnay and two other officers were placed on administrative leave with pay.

Nyah Mway, described as an 8th grader at Donovan Middle School, was a refugee born in Myanmar and a member of the Karen ethnic minority. Karens are among the groups in Myanmar who have been in conflict with the military rulers of the country.

The incident has sparked outrage in the community, with calls for transparency and accountability. The police department is conducting an internal investigation to ensure that proper protocols were followed, while the state attorney general will also investigate the shooting.

In a statement, Utica Police Chief Mark Williams expressed his condolences to the family of Nyah Mway, calling the incident “tragic and traumatic for all involved.”
