The controlling owners of Waco Surf Park have secured a temporary restraining order against a minority owner to prevent the disclosure of confidential information to a rival company. Judge Gary Coley Jr. issued the order following a request from park owners Luke Schock and David Martin. The lawsuit alleges that the defendant, David Likins, conducted an unauthorized tour of the facility with individuals linked to a competing company. Surf Park Owners Obtain Temporary Restraining Order Against Minority Owner

In a surprising turn of events, the controlling owners of Waco Surf Park have taken legal action against a minority owner to prevent him from sharing confidential information with a competing company. The park, located near Axtell, Texas, has become a popular destination for surfers and water sports enthusiasts.

The owners, Luke Schock and David Martin, recently obtained a temporary restraining order against David Likins, a minority owner associated with a company called Calle 26. The legal action was initiated to prevent Likins from disclosing proprietary information about how the surf pool waves are created at the park.

Legal Action and Court Proceedings

Judge Gary Coley Jr. of Waco’s 74th State District Court granted the temporary restraining order at the request of attorney David Deaconson, who represents the controlling owners. A hearing for a permanent injunction has been scheduled for June 11 in Waco’s 474th State District Court before Judge Alan Bennett.

Allegations Against Likins

The legal petition filed by Making Waves Waco LLC, the owner of the park, accuses Likins of taking an unauthorized tour of the facility with a group on May 14. During the tour, Likins allegedly revealed his intentions to build a competing surf park resort in Cabo San Lucas, Mexico, using information obtained from Waco Surf Park.

Likins reportedly asked the park’s facilities manager to provide services at the new park in Mexico and requested access to confidential information about the operation of the Waco park. The suit claims that Likins and his associates took photos and videos of the facilities, including secure buildings, and discussed using a similar wave-generating technology at their new venture.

Violation of Contracts and Trade Secrets

The legal petition alleges that Likins breached his contract and violated the park’s operating agreement by seeking confidential information for personal gain. It also accuses him of violating the Texas Uniform Trade Secret Act and misappropriating trade secrets belonging to Waco Surf Park.

Temporary Restraining Order

The temporary restraining order prohibits Likins from continuing his efforts to obtain confidential information from the park and from sharing that information with others. Likins is also required to disclose the identities of the individuals who accompanied him on the unauthorized tour and return any proprietary information obtained during the visit.

Impact on the Surf Park

Waco Surf Park is one of the few facilities of its kind in the world and has gained recognition as a training spot for elite surfers during the off-season. The legal dispute with Likins highlights the importance of protecting intellectual property and proprietary information in the competitive water sports industry.
