New Delhi: Following the Pune Porsche Case that sent shockwaves across the nation, there are growing calls for a revision of juvenile laws in light of yet another tragic incident in Kanpur. A 15-year-old teenager, who was previously involved in a fatal accident in 2023 that claimed two lives, has now been implicated in another devastating incident. This time, on Tuesday, he ran over four women with his car, sparking renewed demands for a comprehensive review of juvenile laws to effectively address such serious offences.

After Republic World shared an article about the tragic incident in Kanpur on X (previously Twitter), social media was flooded with comments urging a reform of juvenile laws. “Until our laws become stricter, such incidents will continue to occur. This is a pressing issue that requires immediate attention,” shared one X user.

Another commenter questioned, “How is it possible that these **** are not held accountable just because they are juveniles? And what did he do next, he killed 4 more people.. and will once again walk free! How flawed is this law?”

Details of the Kanpur Incident 

A 15-year-old boy, the son of a prominent doctor, tragically ran over four people with his car. The incident took place on Tuesday night as a group of women were crossing GT Road near Maharajpur police station. The women were rushed to the hospital where they were pronounced dead. The deceased victims have been identified as Sarita (40), Poonam Pandey (40), Jyoti Tiwari alias Rupa (30) and Divya alias Chanchal.

Reports suggest that the 15-year-old boy had previously been involved in a fatal accident last October, which resulted in the loss of two lives. Following this latest incident, the teenager was sent to a juvenile home, and legal proceedings against him in the six-month-old case were resumed.

Speaking to a leading daily, Kanpur City Commissioner Akhil Kumar criticised the teenager’s family for allowing him to drive again despite his involvement in a fatal accident the previous year. Kumar emphasised that the city police were taking decisive action to address the issue of underage driving and urged the public to act responsibly.

According to police reports, the teenager was driving a car on Tuesday when he collided with four people, causing them injuries. While the injured received initial medical treatment, the 15-year-old was charged under IPC sections 279 and 338 for reckless driving.

The boy’s father has also been charged in both accidents.

The recent tragedy in Kanpur has further fuelled public outrage following a recent incident involving the alleged deaths of two techies at the hands of a wealthy individual driving a Porsche while intoxicated.

The Pune Porsche Tragedy 

On May 19, a Porsche, reportedly driven by a wealthy individual, collided with a motorcycle in Pune’s Kalyani Nagar, resulting in the tragic deaths of two tech professionals. According to police reports, the juvenile driver was under the influence of alcohol at the time of the incident.

With the case garnering national attention, concerns have been raised about the perceived leniency of the Juvenile Justice Board (JJB). Initially granting bail to the minor, the JJB requested him to write an essay reflecting on the incident. However, in response to mounting public scrutiny, the JJB revoked the bail on Wednesday night. The minor has now been remanded to the Yerawada home, located on the same premises as the JJB, until June 5.

Understanding the Juvenile Justice (Care and Protection of Children) Act 2015

The Juvenile Justice (Care and Protection of Children) Act, passed in Parliament in 2015, replaced the previous laws governing juvenile delinquency, including the Juvenile Delinquency Law and the Juvenile Justice (Care and Protection of Children) Act 2000. A significant provision of the new Act was the provision for the trial of juveniles aged between 16 and 18 years as adults in cases where the nature of the crimes warranted such consideration.

The decision on whether a juvenile should be tried as a minor or an adult was entrusted to a Juvenile Justice Board. This provision gained traction following the 2012 Delhi gang rape case, where one of the accused was just shy of 18 years old and was therefore tried as a juvenile.
