A Mercer County family has taken legal action against the Princeton Police Department following a tragic incident that resulted in the death of Barry Yearout. The lawsuit, filed in U.S. District Court for the Southern District of West Virginia in Beckley, alleges misconduct on the part of the officers involved in the shooting.
Details of the Incident
The incident took place on April 18, 2022, on North 5th Street in Princeton, Mercer County. Officers, including Detective Sean Severt, Earl Leftwich, and Patrolman Jones, responded to a complaint from a neighbor stating that Yearout had driven an all-terrain vehicle and damaged her yard.
Upon arriving at Yearout’s residence, the officers engaged in a verbal exchange with him. Yearout denied the allegations and ordered the officers to leave his property. An altercation ensued, leading to Yearout being shot by Detective Severt.
Controversy Surrounding the Shooting
Princeton police officials claim that Yearout charged at Detective Severt with an aluminum baseball bat, prompting the officer to discharge his weapon. However, video footage obtained through a Freedom of Information Act request does not show Yearout charging at the officer before shots were fired.

Furthermore, it was revealed that Detective Severt was not wearing a body camera at the time of the shooting, which goes against the Princeton Police Department’s policy. The family’s attorneys also alleged that Severt intentionally destroyed his own camera footage, raising questions about the transparency of the investigation.
Legal Action and Past Incidents
The lawsuit, filed by Stroebel and Stroebel on behalf of Yearout’s estate, names the officers involved, City of Princeton Police Chief T.A. Gray, the City of Princeton, and the police department as defendants. The complaint alleges that the officers harbored animosity towards Yearout due to his social media posts critical of local law enforcement.
This is not the first time Yearout has been involved in a legal battle with authorities. In 2014, he sued the West Virginia Regional Jails Authority after being shot in the leg during a raid at Southern Regional Jail. The incident, captured on video, showed Yearout complying with officers before being shot.
