Observations Made by the Police Officer

The Waco police officer followed the SUV to Franklin Avenue and noticed that it was swerving within the lane of travel. The officer further reported that the driver of the SUV seemed to be attempting to gain distance and was traveling at a high rate of speed. Radar captured the SUV traveling at 70 miles per hour in a 40 miles per hour zone on Franklin.

Confrontation and Field Sobriety Tests

The police officer initiated a traffic stop at 26th Street and Clay, where the driver was identified as Caldera.
