Second Group Files Civil Charges Against Driver of Hayrack Ride Crash in Keokuk County

A second group of plaintiffs has recently filed civil charges against Daniel Brubaker, the driver of a hayrack ride that resulted in a tragic accident in rural Keokuk County, leaving multiple middle school-aged children hospitalized. The incident occurred when a goose neck trailer flung the children into the road, according to the plaintiffs.

Details of the Incident

The new charges were brought forth by the Snakenberg family on behalf of a 13-year-old girl identified as E.S. The petition, filed on April 5, states that E.S. was thrown from the trailer onto the ground and subsequently run over by the trailer during the accident. As a result, she suffered numerous injuries.

Allegations of Negligence

The petition accuses Brubaker of negligence and suggests that he may have been intoxicated at the time of the crash. This adds another layer to the already tragic event that unfolded.

Legal Response

In response to the petition, Brubaker defended himself by stating that the accident was not his fault. He claimed that the trailer was operated by him and registered with his vehicle, but he denied most of the family’s allegations. He even requested the court to dismiss the charges against him.

Insurance Company Involvement

The newer petition did not charge the adults who organized the party where the hayride took place. However, it did charge Grinnell Select Insurance Company for allegedly not fulfilling their obligations to pay for E.S.’s injuries as required by their coverage plan.

Grinnell Insurance, in response, denied the charges brought forth by the Snakenberg family. According to court records filed on April 19, the company stated that the plaintiffs had failed to establish all the necessary proof to warrant an insurance payout.
