Wausau Pilot & Review

Portage County District Attorney Cass Cousins made a significant announcement today regarding a tragic incident that occurred in downtown Stevens Point on the night of March 15, 2024. Three men, Brandon L. Boehm and Christian J. Emerson from Wausau, and Arlin O. Sangster from Rothchild, have been formally charged in connection to the fatal assault.

### Charges Filed

The trio has been charged with first-degree reckless homicide as a party to a crime, a Class B Felony that carries a maximum sentence of 40 years in prison. Due to the age of the victim, Donald G. Mitchell, Jr., each defendant faces an increased maximum incarceration of 6 years. Additionally, Boehm, a repeat offender with prior misdemeanor convictions, faces an additional 2 years of initial confinement.

### Details of the Assault

According to reports from Point Plover Metro Wire, Emerson confessed during a police interview to participating in the fatal assault on Mitchell, Jr., whom the suspects did not know. The assault allegedly took place in a parking lot on the south side of Cobblestone Hotel & Suites in downtown Stevens Point, resulting in Mitchell, Jr.’s tragic passing at a Wausau trauma center on March 16.

### Lack of Assistance

Shockingly, none of the suspects called 911 after the assault. Video footage shared on social media purportedly shows the victim lying on the ground, in pain and distress, while the perpetrators callously left the scene, telling him to “have a good night.” Police have verified the authenticity of the video.

### Legal Proceedings

Boehm and Sangster surrendered to the authorities and are currently in custody awaiting a bond hearing on March 21. Meanwhile, Emerson has been released after posting a $50,000 cash bond and is scheduled for an initial court appearance on April 3.

### Additional Suspect Cleared

It was determined that Daemon Kitzrow, previously identified as a suspect, was not directly involved in the assault. Both the Stevens Point Police Department and the Portage County District Attorney’s Office have decided not to prosecute Kitzrow in connection to this tragic incident.

### In Conclusion

It is essential to remember that a charge is merely an accusation, and all defendants are presumed innocent until proven guilty in a court of law. The community mourns the loss of Donald G. Mitchell, Jr., and awaits the outcome of the legal proceedings as justice is sought for this senseless tragedy.
