The incident occurred on February 25th when a site manager discovered two individuals inside the construction site, suspected of being involved in a burglary. The situation escalated quickly, with the suspects allegedly assaulting the site manager by deploying bear spray. In self-defense, the site manager then drew his firearm and fired at the man and woman, resulting in their deaths.

Despite the evidence and circumstances surrounding the case, the shooter was not arrested, and no charges were filed. The Denver District Attorney’s Office released a statement explaining their decision, citing a significant claim of self-defense on the part of the shooter.

Robert McFall, the father of the female victim, expressed his disbelief and grief over the tragic incident. McFall expressed his disagreement with the decision not to press charges against the shooter, stating that no one should be killed for trespassing on a construction site. He called for a reevaluation of the case and for the shooter to be held accountable for his actions.

FOX31 attempted to reach out to the construction company involved in the project for comment but received no response. The investigation into the incident is ongoing, and the community continues to mourn the loss of the two individuals.
