Man Accused of Kidnapping and Killing Local Child Appears in Court

FORT MYERS, Fla. — The man accused of kidnapping and killing a local child made an appearance in court on Monday for a plea hearing, but a plea agreement was not reached.

A pre-trial conference or plea agreement has been scheduled for Wednesday, March 13th. According to Guerrero’s defense team, statutory language was to blame for the lack of agreement.

Nine-year-old Diana Alvarez went missing from her San Carlos Park home on May 29th, 2016. Detectives quickly identified a person of interest: Jorge Guerrero Torres, a family friend.

Despite tracking Guerrero-Torres, detectives were unable to locate Diana. The suspect was questioned about her disappearance and allegations of child pornography found on his phone, including images of Diana.

One year after Diana’s disappearance, Guerrero was sentenced to 40 years in federal prison for the production and possession of child pornography. However, the search for Diana continued until May 2018.

At that time, a grand jury indicted Jorge Manuel Guerrero Torres for first-degree murder, kidnapping, and lewd and lascivious molestation in connection with Diana’s death. State Attorney Amira Fox announced her intention to seek the death penalty in the case.

Two years later, Sheriff Carmine Marceno announced that a body found in Osceola County had been identified as Diana Alvarez. In February of this year, a judge ruled to exclude some of Guerrero’s initial post-arrest interviews with detectives due to a language barrier.

The defense argued that Guerrero should not face the death penalty due to an intellectual disability.

Despite the ongoing legal proceedings, the community continues to mourn the loss of Diana Alvarez and seek justice for her tragic death.
