Colorado Man Arrested for Assaulting Law Enforcement During Capitol Breach

WASHINGTON – A resident of Wheat Ridge, Colorado, has been taken into custody for his involvement in the violent breach of the U.S. Capitol on January 6, 2021. The individual, identified as Matthew James Melsen, 34, faces a series of charges related to his actions during the tumultuous events that unfolded on that day.

Details of the Charges

Melsen has been formally charged with felony offences of civil disorder and assaulting, resisting, or impeding certain officers. Additionally, he faces several misdemeanor charges, including entering and remaining in a restricted building or grounds, disorderly and disruptive conduct in a restricted area, engaging in physical violence in a restricted location, impeding passage through Capitol grounds, and committing acts of physical violence within Capitol premises.

Arrest and Court Appearance

The Federal Bureau of Investigation (FBI) apprehended Melsen on February 28, 2024, in Wheat Ridge. Following his arrest, he appeared in court in the District of Colorado to address the charges brought against him.

Events of January 6, 2021

Court documents reveal that Melsen was captured on police body-worn camera footage at approximately 2:15 p.m. on the West Plaza of the Capitol grounds. Dressed in a white t-shirt, red long-sleeve t-shirt, navy coat, jeans, and a black baseball hat with the slogan “Keep America Great,” Melsen was seen pushing a Metropolitan Police Department officer over the barricades.

Subsequently, Melsen charged at the officer and was sprayed with OC spray before retreating into the crowd of rioters. Later, he was observed climbing onto the Inaugural stage scaffolding and approaching the entrance to the Lower West Terrace Tunnel, a site of intense clashes between rioters and law enforcement.

Legal Proceedings

The case against Melsen is being handled by the U.S. Attorney’s Office for the District of Columbia and the Department of Justice National Security Division’s Counterterrorism Section. Support has also been provided by the U.S. Attorney’s Office for the District of Colorado.

The FBI’s Denver and Washington Field Offices are leading the investigation, with Melsen having been identified as BOLO (Be on the Lookout) #375 on the FBI website. Assistance has been provided by the U.S. Capitol Police and the Metropolitan Police Department.

Ongoing Investigation

Since the events of January 6, 2021, over 1,313 individuals across nearly all states have been charged with various crimes related to the Capitol breach. Among them, more than 469 individuals have been charged with assaulting or impeding law enforcement, a felony offence. The investigation into the events of that day continues.
