A suspect who allegedly fired a handgun while being pursued by Brevard County deputies has been taken into custody. The incident began with a report of a suspicious vehicle near State Road 528 and Banana River Drive, which was relayed to the sheriff’s office on a Saturday morning around 9:15 a.m.

Upon arrival, deputies found the vehicle unoccupied. However, as they were running a check on the vehicle’s details from their patrol car, the suspect, identified as 47-year-old Nickolaos Henke, entered the vehicle and attempted to drive away. When deputies attempted to stop him, Henke provided a false name and then fled on foot.

During the pursuit, Henke leaped into the Banana River and swam back to shore before escaping into the nearby woods. He then threatened the deputies by claiming he was armed, followed by the sound of a gunshot. Henke dropped the firearm before being apprehended.

It was later discovered that Henke had provided a false name as there was an outstanding warrant for his arrest due to failure to appear for a driving under the influence charge. The charges against Henke include aggravated assault against law enforcement with a firearm, resisting arrest without violence, providing false information to officers, and improper exhibition of a dangerous weapon.

During the arrest, two deputies sustained minor injuries. They were taken to the hospital for treatment and subsequently released. The Brevard County Sheriff’s Office confirmed the incident and the charges brought against Henke.
