A Mercer County grand jury has declined to indict the officers in connection to the August 2023 shooting, as confirmed by the Mercer County Prosecutor’s Office to News Center 7.

The investigation into the incident was led by Van Wert County Prosecutor Eva Yarger, who served as the special prosecutor in the case. She presented the case to the grand jury, ultimately resulting in the decision not to press charges against the officers.

Details of the Incident

The incident took place on State Route 29 in Celina during the early morning hours of Aug. 25. Officer David Powell was on patrol when he noticed an SUV parked near Eastview Park, which was closed at the time.

Approaching the vehicle on foot, Powell found Corey Andrew and Hannah Pawelski inside. Upon detecting a strong odor of marijuana emanating from the vehicle, Powell requested identification from the occupants regarding the marijuana.

Andrew refused to comply and accelerated the vehicle suddenly towards the officers, prompting Officer Justin Rice to arrive on the scene for assistance. As the vehicle turned back into the parking lot, Rice fired his weapon as a defensive measure.

Pawelski, who had exited the vehicle, informed the officers that Andrew had been shot and that there was an infant in the car. Despite life-saving efforts, Andrew was pronounced dead at Mercer Health Hospital in Coldwater.

Unforeseen Circumstances

The officers were unaware of the presence of the baby in the car until Pawelski revealed this detail after the shooting. Thankfully, the infant was unharmed in the incident.

Chief Tom Wale of the Celina Police Department stated that Officer Rice sustained significant injuries, including a concussion and neck injuries, as a result of the events that transpired.

The decision by the grand jury not to charge the officers brings some closure to a tragic chapter in the community, while also highlighting the challenging circumstances faced by law enforcement officers in the line of duty.
