Billings Man Sentenced to 20 Years for Coercing Minor to Produce Child Pornography

A man from Billings has been sentenced to 20 years in prison after admitting to coercing a minor girl in New York to create and send him sexually explicit images of herself. Jeffrey Eugene Herbert, 35, pleaded guilty to charges of production of child pornography and possession of child pornography in March. The sentencing was handed down on Feb 15 by US District Judge Dana L. Christensen, who also ordered Herbert to undergo a lifetime of supervised release. US Attorney Jesse Laslovich confirmed that restitution of US$842 was also ordered by the court.

Details of the Case

According to court documents, Herbert was found to have possessed and distributed child sexual abuse material prior to using minor victims to produce the material for his own gratification. The case came to light in June 2022 when the parents of a 13-year-old girl, identified as Jane Doe 1, reported to law enforcement that their daughter had been coerced into creating child sexual abuse material online through a social media application.

An investigation revealed that Jane Doe 1 had exchanged nearly 900 communications with a user named “amberbaby 14141” in June 2022. It was later determined that this user, who turned out to be Herbert, was posing as a 14-year-old girl and soliciting sexually explicit content from the victim. Herbert’s behaviour became increasingly coercive and threatening as he demanded more material from Jane Doe 1, even going as far as threatening to share the videos she had sent him with others and disrupt her life.

Police Action and Investigation

Law enforcement officers executed a search warrant at Herbert’s residence in October 2022 and seized electronic media. During an interview with authorities, Herbert confessed to using the “amberbaby 14141” account to coerce underage girls into producing sexually explicit content. He also provided information on where child sexual abuse material could be found on his phone, leading to the discovery of a hidden application where folders were organised by the names of victims. It was revealed that potentially 22 minor victims were identified, with the content consisting of hundreds of videos and images showing minors from various locations in the country creating child sexual abuse material at Herbert’s direction.

Legal Proceedings

Assistant US Attorney Zeno B. Baucus handled the prosecution of the case, which was investigated by the FBI and Montana Division of Criminal Investigation. The case was brought as part of Project Safe Childhood, a nationwide initiative launched by the Department of Justice in 2006 to combat child sexual exploitation and abuse. The initiative aims to locate, apprehend, and prosecute individuals who exploit children online while also identifying and rescuing victims.

Herbert’s sentencing serves as a stark reminder of the importance of safeguarding minors from online predators and the need for continued vigilance in combating child exploitation in the digital age.
