Deadly Shooting Incident Sparks from Altercation at Fast-Food Restaurant in Ocho Rios

Last month, a tragic incident unfolded outside a fast-food restaurant in Ocho Rios, St Ann, resulting in a deadly shooting that claimed the life of Kajay Simms, a 30-year-old labourer from Gayle, St Mary. The altercation began when a female patron cut the line inside the establishment, sparking a heated argument that quickly escalated into a physical confrontation.

The incident, captured on video, shows Simms and his group of friends and family members waiting in line to place their orders when the woman moved ahead of them, leading to a dispute. The situation soon spilled out onto the street, drawing in others aligned with the opposing factions.

According to prosecutors, Simms brandished a knife and stabbed two men before gunfire erupted, resulting in his own fatal gunshot wound. In the aftermath, three police constables – Huwayne Ramsay, Marcello Kerr, and Jameil Scott – are facing charges of misprison of felon and misconduct in a public office related to the incident.

Civilians Charged with Misprision of Felon

In addition to the police officers, five civilians – Dugeon Hall, Onique Hall, Troy Allen, Moyo Kerr, and Fitzgerald Stewart – have also been charged with misprision of felon. While the civilians have been granted bail, the police constables remain in custody following unsuccessful bail applications.

Attorneys for the accused officers have raised concerns about the treatment of their clients, pointing out that none of the individuals involved were seen with firearms in the video evidence. Despite this, the suspects have been detained since the incident on January 27, with charges only brought forward after three weeks.

Legal Proceedings and Bail Applications

The denial of bail for the police constables has raised questions about the application of the new Bail Act, which allows for the granting of bail even when a suspect has not been formally charged with a crime. However, the officers’ legal representation has highlighted the extended period of detention without charge as a troubling aspect of the case.

As the legal proceedings continue, the accused individuals are prohibited from leaving the island and have been required to surrender their travel documents to authorities. The case remains under scrutiny as more details emerge surrounding the tragic events that unfolded outside the fast-food restaurant in Ocho Rios.
