Non-Fatal Shooting Defendant Acquitted of All Charges in DC Superior Court

On February 15, a non-fatal shooting defendant, Jose Zuniga, was acquitted of all charges in front of DC Superior Court Judge Lynn Leibovitz.

The Incident

Jose Zuniga, 28, stood accused of assault with a dangerous weapon, possession of a firearm during a crime of violence, and simple assault. The charges stemmed from a non-fatal shooting incident that took place on November 11, 2023, at a shelter located on the 400 block of 2nd Street, NW. Fortunately, there were no reported injuries.

The Trial

Throughout the trial, prosecutors presented eyewitness testimonies, including that of the victim, who identified Zuniga as the shooter. In addition, surveillance footage from the shelter was shown, capturing Zuniga running across the lobby after shots were fired.

However, one of the eyewitnesses testified that Zuniga was not the shooter, stating that the perpetrator wore a white puffer coat during the incident. In contrast, Zuniga was seen in the footage wearing a white hoodie with images of Mickey Mouse on it.

In an effort to prove his innocence, Zuniga took the stand and testified that he tried to leave the location when the altercation started. However, he was challenged to a fight by the victim and his brother. Zuniga claimed that he and the victim engaged in a “struggle” in the hallway before he managed to escape and seek help.

Zuniga admitted to threatening the victim’s brother with a drill but fled when he saw the brother wielding a knife. According to Zuniga, he heard the first gunshot while running to hide. He claimed that the subsequent shots were fired by an individual in a white puffer coat known as “El Mecanico,” whom he had seen during the second and third shots. Zuniga argued that the video showing him running across the shelter lobby was him “escaping.”

The Verdict

After a day of deliberations, the jury acquitted Zuniga of all charges, resulting in his release from jail. No further court dates have been set in relation to this case.
