Animal Cruelty Charges Dropped Against Man Accused of Taking Monkeys from Dallas Zoo

DALLAS — In a recent development, animal cruelty charges have been dropped against a 25-year-old man who was accused of taking two monkeys from the Dallas Zoo. The charges were dismissed after he was found incompetent to stand trial. However, he still remains in custody as he faces two burglary charges relating to mysterious incidents that occurred at the zoo last year.

Davion Irvin, the accused, has been ordered to a state hospital and is currently deemed incompetent to stand trial, as per court filings. Prosecutors explained in the recent filings on Monday that they were dismissing six misdemeanor animal cruelty charges against Irvin as he had already served the maximum amount of jail time for these charges.

The Dallas County district attorney’s office stated on Friday that due to the passage of a year without Irvin’s competency being restored, they were legally obliged to dismiss the misdemeanor cases. However, Irvin is still confronted with two felony burglary charges, one relating to the theft of the monkeys and the other concerning the escape of a clouded leopard named Nova.

Irvin’s arrest took place in February last year, following a series of unusual events. The zoo workers had discovered that Nova’s enclosure had been cut open, and she was missing. The zoo was temporarily closed as a search was conducted. Fortunately, Nova was found later that day near her habitat. On the same day, another similar cut was discovered in the enclosure housing langur monkeys, but none of them had managed to escape.

Approximately two weeks after Nova’s escape, two emperor tamarin monkeys named Bella and Finn were reported missing from their enclosure. Dallas police released a photo and video of a man they wanted to question in connection with the case, who was later identified as Davion Irvin. These images led to a tip, which ultimately led the police to a vacant residence where Bella and Finn were found.

Two days after the discovery of the missing monkeys, Irvin was arrested when he was seen inquiring about animals at a Dallas aquarium. A worker recognized him and alerted the authorities. During his arrest, Irvin confessed to loving animals and even mentioned that if released from jail, he would continue stealing them, according to an arrest affidavit.

Approximately a week after Nova’s escape, a vulture named Pin was found dead. At that time, the authorities had not linked Irvin to the vulture’s demise. However, the zoo recently revealed that the U.S. Fish and Wildlife Service determined the punctures and lacerations on Pin’s back were consistent with those caused by a predator, possibly a feline.

As of Friday, Dallas County jail records indicated that Irvin is still in custody. Requests for comments from Irvin’s attorneys went unanswered.
