Newport News Man Arrested for Assaulting Law Enforcement during U.S. Capitol Riot

A 34-year-old man from Newport News, Virginia, has been arrested and charged in connection with assaulting law enforcement during the January 6, 2021, U.S. Capitol Riot. Matthew Stalling now faces multiple felony and misdemeanor charges.

Charges Filed Against Matthew Stalling

According to a press release from the D.C. U.S. Attorney’s Office, Matthew Stalling has been charged with felony offenses of civil disorder, engaging in physical violence against any person or property while using or carrying a deadly or dangerous weapon, and assaulting, resisting, or impeding certain officers. He also faces misdemeanor charges related to being in a restricted building.

Identification of Matthew Stalling

Court documents state that Matthew Stalling was identified through video and images taken during the riot near the Lower West Terrace Tunnel of the U.S. Capitol building. The tunnel, which was being prepared for the upcoming Presidential Inauguration, witnessed some of the most violent attacks against law enforcement on that day.

Evidence against Matthew Stalling

Images clearly show Matthew Stalling wearing a 3M brand respirator mask and a tan military-style helmet with a flashlight and black and white Gadsden patch attached to the left side. Surveillance footage captured at around 4:15 p.m. shows Stalling approaching the mouth of the tunnel, raising a canister, and spraying an orange substance at police officers assembled inside. The officers reacted in pain, unable to perform their duties. Stalling then threw the empty canister at the officers. The substance was later identified as oleoresin capsicum (OC) spray.

Matthew Stalling’s Remarks

In a YouTube video, Matthew Stalling can be seen describing how officers pepper-sprayed him. He proudly displayed his helmet and mask, which matched those seen in other footage. At one point in the video, Stalling referred to his mask and advised others to invest in one if they planned to confront law enforcement.

Legal Proceedings and Investigation

This case is being prosecuted by the U.S. Attorney’s Office for the District of Columbia and the Department of Justice National Security Division’s Counterterrorism Section. The FBI’s Norfolk and Washington Field Offices are conducting the investigation. The U.S. Capitol Police and the Metropolitan Police Department have provided valuable assistance.

Ongoing Investigation and Charges

Since January 6, 2021, a total of 1,313 individuals have been charged in connection with the breach of the U.S. Capitol, including over 469 individuals charged with assaulting or impeding law enforcement. The investigation into the events of that day is still ongoing.
