Man Accused of Kidnapping and Killing 13-Year-Old Hania Aguilar Faces Trial Delay

ROBESON COUNTY, N.C. – The trial for Michael McLellan, the man accused of kidnapping, raping, and killing 13-year-old Hania Aguilar in Robeson County in 2018, has been postponed once again. Originally scheduled for February 5th, the trial will now take place on July 22nd after a hearing in Robeson County Superior Court on Tuesday.

This is the second time the trial has been delayed. McLellan was initially set to go on trial in September, but last April, Superior Court Judge James Gregory Bell granted a motion to continue the trial until February.

McLellan is facing a multitude of charges, including first-degree murder, first-degree force sex offense, statutory sexual offense with a person under 15 years of age, larceny of a motor vehicle, felonious restraint, abduction of children, concealing/failing to report the death of a child, first-degree forcible rape, statutory rape of a child under 15, and first-degree kidnapping. These charges stem from the alleged kidnapping of Aguilar on November 5, 2018, from a yard in the Rosewood Mobile Home Park in the Lumberton area, followed by her tragic death.

The indictment, returned on May 6, 2019, revealed the extent of the charges against McLellan. It is alleged that he forced Aguilar into a stolen SUV, which was later discovered in Lumberton. Her body was tragically found on November 27, 2018, off Wire Grass Road in the Lumberton area.

In June 2019, it was revealed that prosecutors would be seeking the death penalty in McLellan’s case, making the trial all the more significant.
