Fairfield Man to Face May Jury Trial for Double Murder

A 27-year-old Fairfield man accused of killing two men and wounding a third in March 2022 in Fairfield will face a May jury trial in Solano County Superior Court.

Judge Sets Trial Date

Trine Daniel Martinez, who pleaded not guilty to the charges, appeared in Department 11 on December 11. Judge William J. Pendergast III ordered Martinez to return for trial at 9:30 a.m. on May 6 in the Justice Center in Fairfield. The judge also scheduled some pretrial matters, including a trial confirmation on February 5 and a trial management conference on May 2.

Denying All Allegations

Martinez, currently in custody without bail at the Stanton Correctional Facility in Fairfield, has denied all enhancements and allegations. He is represented by Fairfield criminal defense attorney Thomas Maas. Deputy District Attorney Bill Ainsworth leads the prosecution for the Solano County DA’s Office.

Victims Identified

The two deceased men have been identified as Earl Wayne Wyatt III, 44, of Fairfield, and Damion Davis, 36, of Suisun City. Wyatt was pronounced dead at the shooting scene, while Davis was wounded and hospitalized in grave condition. Unfortunately, Davis later succumbed to his injuries at a local hospital.

Surveillance Footage and Arrest

Martinez was identified as the shooting suspect from surveillance camera footage at the crime scene, a convenience store located in the 200 block of East Tabor Avenue. He turned himself in to Fairfield police on March 14, one day after the shootings. At the time, he was accompanied by criminal defense attorney Daniel J. Russo of Vallejo, but did not make a statement. Martinez was booked into jail on suspicion of murder and two counts of attempted murder. However, the charges have since been updated to two counts of first-degree murder and one count of attempted murder for wounding a 28-year-old Suisun City man who has not been identified.

Altercation Leads to Fatal Shootings

According to investigators, the shootings were prompted by an altercation between the involved parties. Officers responded to reports of gunshots and found three victims near an unidentified business. Wyatt was declared dead at the scene, while Davis and the third man were taken to a local hospital by ambulance.

Arrest Warrant and Criminal Complaint

Detectives obtained an arrest warrant for murder, naming Martinez, and served a search warrant at his residence on San Jose Street in Fairfield. The criminal complaint against Martinez was filed on March 16, 2022.

Possible Prison Sentence

If found guilty at trial, Martinez faces more than 50 years to life in prison, in addition to potential additional time for using a firearm.
