On the afternoon of January 19, at approximately 3:32 p.m., a trooper was approached by a 38-year-old man who had sustained a stab wound to his hand at the Wendy’s restaurant located at 19054 Coastal Highway in Rehoboth Beach. According to the investigation, the victim was seated in the passenger seat of a parked car when he was approached by an acquaintance, identified as Kevin Clary. Clary, who had been inside the Wendy’s, became aware of the victim’s presence in the parking lot and made threatening remarks before stepping outside. Upon reaching the victim’s car, Clary forcefully opened the door and demanded money while repeatedly stabbing at him with a knife and uttering threats to kill him. The victim managed to close the door to fend off the assault. Clary responded by kicking the door until the victim’s girlfriend returned to the car and drove them to a nearby business where they sought assistance from a trooper.

The injured victim was promptly transported to a local hospital by ambulance for medical treatment. Troopers quickly located Clary near a wooded area on Coastal Highway and apprehended him without any resistance.

Following his arrest, Clary was taken to Troop 7, where he faced the following charges: Attempted Robbery First Degree (Felony), Assault First Degree (Felony), Possession of a Deadly Weapon During the Commission of a Felony (Felony), Possession of a Deadly Weapon by a Person Prohibited (Felony), Terroristic Threatening, Possession of Drug Paraphernalia, and Disorderly Conduct. Clary was subsequently arraigned by Justice of the Peace Court 3 and remanded to Sussex Correctional Institution after failing to post a $64,300 cash bond.
