It was only after the French and Dutch law authorities cracked the EncroChat phone network that messages linked to Ferguson were uncovered, helping to identify him as the assailant. An extradition request was made, and he was brought back to Scotland in May 2022.

At the sentencing, Ferguson expressed remorse for his actions, and his lawyer highlighted that the incident was not premeditated but a spontaneous response to a fear of assault. However, the judge emphasized the tragic consequences of Ferguson’s actions and the impact it had on Bates’ family.

Moira Orr, who leads on homicide and major crime for the Crown Office and Procurator Fiscal Service (COPFS), stated that Ferguson’s attempt to evade justice failed and he would now serve a lengthy prison sentence.
