In a statement released on Thursday, the Sacramento District Attorney’s Office confirmed that a 10-year-old California boy, who was arrested after allegedly shooting another boy with a stolen gun, will not be charged for the incident. The boy had found the firearm in his father’s car, leading to a tragic outcome.

The boy’s father, Arkete Davis, aged 53, appeared in court on Wednesday and faced charges including criminal storage of a firearm, child endangerment, and possession of a firearm as a felon. The District Attorney’s office has emphasized that the sole criminal liability for the child’s death lies with Davis.

The recovered firearm, which had been reported stolen in 2017, was found in Davis’ possession. It has been revealed that Davis was legally prohibited from owning or possessing a gun.

Following the incident, Davis’ son was initially held in the Sacramento County Youth Detention Facility. However, he has since been released and reunited with his mother in Sacramento.

The victim of the shooting has been identified as 10-year-old Keith Frierson. Authorities responded to a call reporting a shooting and discovered Frierson bleeding from his head and neck in a parking lot on Saturday afternoon.

Despite being rushed to the hospital, Frierson was pronounced dead. Sadly, his death adds to the alarming statistics of over 1,600 children and teenagers who lost their lives to gun violence in 2023, as reported by the Gun Violence Archive.

Detectives from the Sacramento County Sheriff’s Office discovered a gun in a nearby trash can, where it is believed Davis attempted to dispose of it. This crucial piece of evidence further incriminates Davis in the case.

Currently, Davis is being held without bail. A bail review is scheduled for Friday. The DA’s office has not assigned him an attorney yet, as confirmed by Sacramento County’s Conflict Criminal Defenders.
