Texas Man Charged with Felony Murder in Case Involving a Fatal Robbery

A Houston man is facing murder charges after allegedly “coaching” a 16-year-old during a robbery that resulted in the teenager’s death. The accused, Larry Holmes, has been charged with felony murder under the Texas “law of parties,” according to legal analyst Carmen Roe from KHOU 11 News.

The incident occurred on December 12, when Edwin Quinones, the 16-year-old victim, was shot and later found dead in an elevator at the Haven at Elgin apartments in Houston.

Carmen Roe explained that many people believe murder in Texas can only be committed if there is an intentional killing. However, this case is unique, as Holmes was charged despite not being present during the robbery. Quinones died while attempting to rob two men at gunpoint in an elevator, and he was shot during a struggle that ensued.

Authorities have evidence showing that Holmes and Quinones were in communication during the robbery, although the nature of this communication has not been specified.

The law of parties in Texas holds each person involved in a crime responsible, treating them as a “party” to the offense. In this case, Holmes is considered criminally responsible for the felony of aggravated robbery because he allegedly encouraged Quinones to carry out the crime. Moreover, as the crime resulted in a death, Holmes is also legally responsible for that outcome.

Roe mentioned that it will be challenging to defend Holmes against the murder charge, as it hinges on intent. The evidence shows that both Holmes and the 16-year-old engaged in the offense of aggravated robbery.

The person who shot Quinones is unlikely to face charges, as their actions may be considered self-defense, according to Roe.

At the time of Quinones’ death, Holmes was already facing three prior felony charges in Harris County. He is currently being held on a $275,000 bond.

The Haven at Elgin apartments have been plagued by frequent gunfire incidents, according to residents. One resident, who wished to remain anonymous, expressed that Quinones’ death has intensified their fear and discomfort in the area.

Holmes is scheduled to appear in court again on January 4.
