A 25-year-old resident of Kettering, Antonio Nathan Rose, has been sentenced to a probationary period of up to five years after being involved in an incident with the local police. The sentencing was carried out on December 27, 2021, at the Montgomery County Common Pleas Court. Rose pleaded no contest to trespassing in a habitation and misdemeanor aggravated menacing, as stated in the bill of information, and pleaded guilty to misdemeanor domestic violence, according to the filed sentencing documents on Thursday.

The incident occurred on August 3, 2021, when the Kettering Police Department received a distress call at around 9 p.m. The call reported an attack on a woman by a man, later identified as Antonio Nathan Rose, who was the estranged boyfriend of the victim. The assailant then proceeded to barricade himself inside the woman’s apartment located in the 500 block of Hadley Avenue. The Tactical Crime Suppression Unit, composed of officers from eight different local police departments, was dispatched to the scene.

According to an official statement from the Tactical Crime Suppression Unit, the responding officers encountered resistance when attempting to apprehend Rose. He failed to comply with their instructions, which led to one of the Kettering officers firing multiple shots from his service weapon, resulting in Rose sustaining multiple gunshot wounds. The statement further added that the officer’s use of force was necessary to neutralize the threat posed by Rose.

Following the incident, a county grand jury reviewed the case in September and decided not to indict the officer who had shot Rose. Although the officer was initially placed on administrative leave, he was later reinstated to active duty. In compliance with Marsy’s Law, which protects the identity of crime victims, the Kettering Police Department refrained from disclosing the officer’s name.

Initially, Rose faced multiple charges, including burglary and abduction, both classified as felonies, along with domestic violence, aggravated menacing, and two counts of assault, which were misdemeanor charges, according to the court records.

As part of his sentencing, Antonio Nathan Rose will be required to complete domestic violence counseling and maintain no contact with the victim. Failure to comply with these conditions may result in imprisonment for a maximum period of 1 1/2 years, as stated in the sentencing documents.
