Iowa Deputy Justified in Shooting Man Accused of Random Grocery Store Killing

An Iowa deputy has been deemed justified in shooting a man who allegedly killed a grocery store worker at random, according to Delaware County Attorney John Bernau. In a statement released on Thursday, Bernau stated that Deputy Matt Menard’s decision to shoot Nathan Russell in November was reasonable and necessary to protect not only his own life but also the lives of nearby citizens.

Russell, aged 39, is currently in jail facing first-degree murder charges along with other offenses. His next court hearing is scheduled for January 5th. No immediate response was received from Russell’s attorney when contacted on Friday.

The incident occurred on November 7th, when Aaron McAtee, a 48-year-old employee of Fareway Meat and Grocery store, was shot near a loading dock in Monticello, a small town in eastern Iowa with a population of around 4,000 people. Police Chief Britt D. Smith described the act as an “act of random violence.”

As a result of the shooting, McAtee was airlifted to a hospital where he later succumbed to his injuries.

Following a thorough investigation, law enforcement officials identified Russell, an East Dubuque, Illinois resident, as the prime suspect and initiated a search. A Delaware County deputy spotted Russell in Hopkinton, Iowa, approximately 10 miles away from Monticello.

Deputy Menard, who was later revealed as the officer involved, attempted to detain Russell, but he refused to comply. In response to the threat, Menard discharged his weapon, shooting Russell.

Delaware County Attorney John Bernau stated, “When looking at the incident objectively, Deputy Menard’s actions in shooting Russell were reasonable and legally justified under Iowa law. He will not face any criminal liability.”

Matt Menard, a 25-year veteran of law enforcement, including 14 years with the Delaware County Sheriff’s Office, has been commended for his actions in this incident.

This shooting incident serves as a reminder of the risks faced by law enforcement officers in the line of duty. The swift and decisive action taken by Deputy Menard highlights the importance of well-trained and experienced officers who are prepared to protect the public in dangerous situations.
