Florida Man Arrested After 4-Year-Old Child Gets Shot on Christmas Night

A man from Collier County, Florida, was taken into custody on Tuesday following an incident where a 4-year-old child was shot on Christmas night, as reported by the Collier County Sheriff’s Office.

According to the deputies’ affidavit, they received a distress call regarding the injured child and immediately responded to a residence in Naples on Christmas night.

Upon their arrival, the deputies discovered that the child had sustained a gunshot wound to his leg, specifically “just above the ankle but below the calf.”

Further investigation revealed that the incident occurred during a Christmas get-together at the home. The resident of the house informed the detectives that his cousin, identified as Diego Diaz-Martinez, 31, had expressed a desire to see one of his firearms as he wanted to own a gun himself and found them intriguing.

The resident proceeded to retrieve his firearm from a secure gun safe in the bedroom and showed it to Diaz-Martinez, who was holding his own daughter at the time, according to the affidavit.

Tragically, while examining the firearm, Diaz-Martinez accidentally discharged it, causing a bullet to penetrate the wall. The sound of the gunshot was immediately followed by the cries of the injured child, who was in another room.

The affidavit states, “It should be noted while deputies were attempting to gather further details about what had occurred, various family members present stated they did not know what had occurred or were not wanting to speak.”

Subsequently, the child’s mother reported that her son had suffered a broken tibia as a result of the incident.

Diaz-Martinez now faces several charges, including shooting into a dwelling, child neglect with great bodily harm, child neglect without great bodily harm, and using a firearm under the influence of alcohol.
