FREMONT — A man who had previously been convicted of attempted murder as a juvenile is now facing charges of murder and other crimes in connection with a fatal shooting that occurred at an apartment complex in Fremont. Darreis Buckley, 26, who was a resident of the apartment complex where the incident took place, has been charged with murder, unlawful firearm activity, and possession of a firearm by a felon. The charges against him include several enhancements, one of which alleges that he was on parole at the time of the killing.

Initially, the girlfriend of the accused was arrested on suspicion of murder, but authorities have clarified that she has not been charged in relation to the case. As per records from Santa Rita Jail, she remains in custody as of Friday afternoon.

Court documents reveal that Buckley admitted to being present at the scene of the crime. He confessed to shooting at the victim multiple times and disposing of the firearm as he fled.

The victim has been identified as Darwin Foster, a 53-year-old resident of Oakland.

The fatal shooting occurred at approximately 8:30 p.m. on Tuesday at an apartment complex located in the 3000 block of Medina Common, where both Buckley and his girlfriend resided, according to court records.

According to the same records, Foster was shot in a hallway after leaving an apartment. Video surveillance footage shows Buckley pointing a gun at Foster and subsequently firing multiple shots as Foster attempted to flee the scene.

The records also indicate that Foster possessed a gun, which fell to the ground without being discharged after he was shot. Foster was pronounced dead at the apartment complex.

During police questioning, Buckley’s girlfriend initially denied any knowledge of him but later identified him as the shooter depicted in the surveillance video. She informed investigators that they had been in an intimate relationship since 2021 and that Buckley would become angry when she interacted with other men.

Buckley was apprehended in West Oakland on Wednesday afternoon.

Court records reveal that Buckley has a history of three prior felony convictions. In 2014, at the age of 16, he was convicted of attempted murder in Alameda County, which led to his incarceration. Additionally, he has convictions for assault with force likely to produce great bodily injury in 2018 and evading an officer with willful disregard for public safety in 2023. Details regarding these cases are not immediately available.

Buckley is currently being held without bail at Santa Rita Jail and is scheduled to enter a plea on December 28th.
