Man Shot and Killed in Clifton Forge Police Shooting: Alleghany County Commonwealth Attorney Determines Incident as Justifiable Homicide

CLIFTON FORGE, Va. (WFXR) — Almost half a year has passed since a tragic incident unfolded at the Oak Hill Apartments in Clifton Forge, resulting in the death of a man due to a police shooting. After a thorough investigation, Alleghany County Commonwealth Attorney Ann Gardener has concluded that the actions of the officers involved were justifiable, ruling out any criminal charges against them.

In an official statement, Gardner explained that on June 30, 2023, the Clifton Forge Police Department and the Alleghany County Sheriff’s Office received a distressing report about a man who exhibited signs of instability, suicidal tendencies, and was believed to be armed with a knife. The report originated from a concerned 911 caller who described the man, later identified as 38-year-old Leonidas Tamanini, as being “out of control.”

Upon arrival at the scene in the 1600 block of Oak Hill Avenue, law enforcement officers encountered Tamanini in a highly agitated and unpredictable state. According to the report provided by Gardner’s office, Tamanini allegedly attempted to inject himself with a needle. Despite repeated orders from the officers to drop the needle, Tamanini disregarded their commands. In an attempt to prevent him from causing harm to himself, the officers deployed a Taser. However, Tamanini allegedly responded by charging towards the officers, prompting one of them to discharge their firearm. Tragically, Tamanini succumbed to his injuries at the scene.

Gardner’s decision not to pursue criminal charges against the officers involved was based on a comprehensive examination of multiple pieces of evidence, including body-worn camera footage, forensic reports, witness testimonies, and Tamanini’s autopsy report. Additionally, she analyzed Tamanini’s toxicology report, revealing the presence of methamphetamine, amphetamine, and THC in his bloodstream.
