A Vernon man received a visit from law enforcement after mistakenly sending a nude photo to someone he believed was a 15-year-old girl.

According to a recent decision by the Vernon Provincial Court, the man, referred to as L.S., unknowingly sent the explicit photo to the father of a teenage girl during a series of text conversations that spanned over two weeks.

At the time of the incident, L.S. was 34 years old. He sent the unsolicited photo of his penis in a text message, thinking he was communicating with a minor.

The conversations began when another man, identified as Mr. N., discovered a blocked contact on his teenage daughter’s phone. Concerned about the unusual block, Mr. N. sent a text message to inquire about the reason for the block.

What followed was a conversation between L.S. and Mr. N., with Mr. N. posing as a 14-year-old girl named M. However, all communication was between the two adult men, as the underage victim’s identity was protected by a publication ban.

The conversations continued for two weeks, briefly pausing when L.S. suggested they resume once the girl turned 18. During this time, the fictional 14-year-old girl celebrated her birthday, and L.S. wished her a happy birthday, sparking the continuation of their exchange.

L.S. asked for a photo of the girl, to which Mr. N. responded by sending an altered old photo of his girlfriend. L.S. complimented the photo, describing the girlfriend as beautiful, according to the court decision.

As the conversation progressed, L.S.’s comments became increasingly sexually suggestive. He expressed his desire to engage in sexual activities with the girl and made inappropriate remarks about her age. He even arranged to provide her with alcohol and made vague plans to meet after work the following day.

Three hours later, L.S. sent an unsolicited photo of his penis and repeatedly asked the girl if she liked it. He then requested a photo of her in return.

Mr. N. promptly reported the explicit photo and the entire conversation to the police, leading to L.S.’s arrest at his workplace.

The consequences of L.S.’s actions extended beyond his criminal charges. According to the court decision, he also experienced the dissolution of his marriage.

L.S. was ultimately convicted by a judge of communicating with a person believed to be under 18 for the purpose of accessing child pornography. He received an 18-month conditional sentence, with the first nine months to be served under house arrest, allowing exceptions for work and healthcare. The remaining nine months will be subject to a curfew.
