Calcutta High Court: Suicide within 7 Years of Marriage Not Always Abetted by Husband and In-laws

In a significant judgment, the Calcutta High Court overturned the conviction of a man accused of abetting his wife’s suicide. The court ruled that a woman’s suicide within seven years of marriage does not automatically implicate her husband and in-laws for abetment. The court emphasized the need for concrete evidence of cruelty by the accused to establish the presumption of abetment. The accused husband had been convicted based on an FIR filed by his wife’s father, but witnesses denied any knowledge of the cause of the woman’s death. The court criticized the trial judge for relying on speculation rather than evidence.
