Details of the Incident

On the fateful day, the parents of the young girl had left her at home to attend their work at a nearby plantation. Upon their return, they were greeted with the devastating sight of their innocent daughter hanging lifeless from the ceiling fan. The authorities were immediately alerted, leading to a police investigation. Initially, the case was registered as an “unnatural death,” but a subsequent autopsy report revealed the horrifying truth.

The examination confirmed that the six-year-old had been subjected to multiple instances of sexual assault, resulting in her losing consciousness. In a horrific turn of events, the accused perceived her to be dead and proceeded to hang her from the ceiling fan. The incident, which occurred on June 30, 2021, garnered widespread attention, leading to the establishment of a fast track court to expedite the legal process.

The Acquittal

However, two years later, the accused, identified as Arjun, has been acquitted by the special court constituted in Idukki to handle cases under the Protection of Children from Sexual Offences (POCSO) Act. The court’s ruling stated that the prosecution failed to establish all the circumstances consistent with the guilt of the accused while being inconsistent with his innocence.

Explaining the verdict, the court highlighted the importance of a thorough investigation in cases of unnatural death. It emphasized that the investigating officer should promptly reach the crime scene, meticulously inspect the premises, collect evidence, and document minute details until the truth is unveiled.

The court attributed the acquittal to the unscientific collection of evidence, lacking the shrewdness and intelligence expected from an investigating officer. This negligence severely impacted the timely collection of evidence in the case.

Political Fallout and Response

The acquittal has sparked a massive political row in Kerala, with the Opposition launching a vehement offensive against the Pinarayi Vijayan government. The Leader of the Opposition in the Kerala Assembly, representing the Congress party, expressed strong criticism towards the investigating officer’s handling of the case. He emphasized the numerous faults pointed out by the judge and the officer’s failure to visit the crime scene on the day of the incident.

Furthermore, the prosecution’s presentation of evidence was deemed contradictory and lacking clear substantiation. Kerala Chief Minister Pinarayi Vijayan acknowledged the seriousness of the matter and stated that the state cannot be proud of the acquittal. He assured that necessary actions would be taken, including filing an appeal. The court’s observations will also be carefully considered.
