Couple from North Carolina Arrested for Capitol Breach on Jan. 6

WASHINGTON – A couple hailing from Snow Hill, North Carolina, has been apprehended on multiple felony and misdemeanor charges in connection with their involvement in the breach of the U.S. Capitol on January 6, 2021. Their actions, along with those of numerous others, caused significant disruption during the joint session of the U.S. Congress, which had convened to certify the electoral votes for the 2020 presidential election.

Curtis Davis, aged 45, and Tonya Bishop, aged 48, are now facing charges outlined in a criminal complaint filed in the District of Columbia. The complaint accuses them of engaging in civil disorder, as well as assaulting, resisting, or impeding certain officers, both of which are classified as felony offenses. Additionally, the couple has been charged with several misdemeanor offenses, including trespassing and remaining in a restricted building or grounds, disorderly and disruptive conduct in a restricted area, engaging in physical violence within a restricted area, disorderly conduct in the Capitol building, committing acts of physical violence on the Capitol grounds or buildings, and participating in parades, picketing, and demonstrations within a Capitol building.

Following their arrest on December 8, 2023, in Snow Hill, Davis and Bishop are scheduled to make their initial appearances today in the Eastern District of North Carolina.

According to court documents, Davis and Bishop were identified through publicly available video footage as being present inside the Capitol building on January 6, 2021. Davis can be seen in the footage wearing a black beanie-style hat adorned with a U.S. flag featuring a thin blue line, sunglasses, a gray and tan coat, a blue/gray shirt depicting a skull with a thin blue line, stars, and stripes, and a gray, long-sleeve shirt. Bishop, on the other hand, is depicted wearing light-colored gloves, the same blue sweatshirt with stars and stripes, including a hood with white stars as previously described, and a black jacket with pink writing on the back.

Law enforcement officials analyzed surveillance footage captured within the Capitol building, which revealed Davis and Bishop entering the premises and becoming involved in an escalating conflict between rioters and law enforcement personnel. The footage clearly shows Davis shoving and punching officers who were attempting to disperse the rioters. He then moved away from the police officers before re-engaging and delivering more punches.

Another video footage showed Davis aggressively yelling at officers while Bishop physically restrained him. Subsequently, Davis was seen fighting with law enforcement officers. Court documents indicate that Davis threw punches at multiple police officers, including making contact with at least one Metropolitan Police Department (MPD) officer. In later footage, Davis admitted to having injured his knuckles during the confrontation. Bishop can also be seen on security footage as she placed her hands on and pushed police officers who were trying to disperse the rioters from the Rotunda.

Additional body-worn camera footage reviewed by law enforcement revealed Davis, Bishop, and other rioters inside the Capitol attempting to seize control of an MPD officer’s baton. In this footage, Davis was observed shoving and punching an MPD officer before taking possession of the officer’s police baton.

According to court documents, both Davis and Bishop actively resisted, obstructed, and interfered with MPD officers who were working to remove rioters from the Rotunda. Body-worn camera footage captured Bishop repeatedly resisting and refusing to comply with an MPD officer’s attempts to move her. At one point, she told the police, “You can’t turn on Americans,” and proceeded to place both hands on an MPD officer’s baton before being pushed away by another officer.

Further open-source video footage reviewed by law enforcement showed Davis and Bishop outside the sealed doors of the Capitol building. Bishop was identified as being interviewed on the Capitol steps and standing on top of a law enforcement vehicle, addressing the crowd through a megaphone. In the video, Bishop encouraged others to remain inside the building and questioned why people were leaving. She stated, “This is our one chance,” and expressed her readiness to return inside, emphasizing that it was “our f— building.” Davis was also present during this incident, capturing images and filming Bishop.

Prosecution for this case is being undertaken by the U.S. Attorney’s Office for the District of Columbia, along with the Department of Justice National Security Division’s Counterterrorism Section. The U.S. Attorney’s Office for the Eastern District of North Carolina has provided valuable assistance in this matter.

The FBI’s Charlotte and Washington Field Offices are leading the investigation, with support from the U.S. Capitol Police and the Metropolitan Police Department.

Since January 6, 2021, over 1,230 individuals have been charged in almost all 50 states for crimes related to the breach of the U.S. Capitol. Among these charges, more than 440 individuals have been accused of assaulting or impeding law enforcement, which is a felony offense. The investigation into this incident is ongoing.
