Accident – Death – Obituary News : SPEEDWAY, Ind. (WISH) — A man has been formally charged by prosecutors on Friday for the fatal shooting of a 17-year-old boy at a residence in Speedway on November 12th.

The teenager, identified as Caiden Clements by the Marion County Coroner’s Office, tragically lost his life in the incident.

Benjamin Mulkey, aged 19, is now facing serious felony charges, including murder and two counts of pointing a firearm at another individual.

According to a probable cause affidavit obtained by News 8, Speedway police officers received a call reporting a shooting at a house in the 2200 block of North Auburn Street. Upon arrival, they encountered a juvenile male who informed them that his “brother” had been shot at a nearby residence. Although he couldn’t lead the officers to the exact location, he provided a description of the vehicles present at the house.

Based on this information, the police swiftly located the property on West 22nd Street, which was less than a minute away from where they spoke to the juvenile. Officers knocked on the door and were met by Mulkey’s grandparents, who confirmed that someone had been shot and required immediate assistance.

Upon entering the premises, the officers discovered an unconscious male, later identified as Clements, lying near the top of the basement stairs. Tragically, he was pronounced dead at the scene.

Following the incident, detectives interviewed numerous witnesses present at the time of the shooting. One juvenile witness revealed that he and Clements had been out with another person before arriving at the residence on West 22nd Street. Mulkey, who the witness had never met before, greeted them and led them down to the basement. The witness explained that several individuals, including Mulkey, Clements, the witness himself, Mulkey’s girlfriend, and others, were present in the basement.

While in the basement, Mulkey took out a rifle from beneath a bed and began showing it to the others. As the firearm was passed around, another juvenile male inadvertently jammed the gun. Despite the witness’s warning that the rifle still had a round in the chamber, Mulkey denied this fact and insisted on having his weapon back.

When the witness displayed the round to Mulkey, he became agitated and pointed the rifle at the witness and the other juvenile, demanding to know who had loaded the gun. The witness told investigators that the other male jokingly claimed it was Clements who loaded the rifle. In response, Clements stood up from the futon he was sitting on, and Mulkey shot him in the chest.

Clements, clutching his chest, managed to run up the basement stairs before tragically collapsing at the top. Shockingly, Mulkey allegedly told the witness not to call the police when he mentioned that he was going to seek help.

Subsequently, detectives interviewed a second juvenile witness who initially claimed to have been asleep upstairs during the shooting. In an attempt to protect Mulkey, the second witness falsely confessed to the crime. However, after the witness’s mother insisted that Mulkey must face the consequences of his actions, the witness changed their statement.

The second witness revealed that when in the basement, they had asked Mulkey to see the rifle. Mulkey removed the magazine before handing it over, but the witness reattached the magazine and returned the weapon to Mulkey, notifying him that there was a live round in the gun. The witness also mentioned that they had informed Mulkey about a possible issue with the ejector on the rifle.

As Mulkey inspected the rifle’s sights, the gun unexpectedly discharged when Clements stood up from the futon, resulting in the fatal shot, according to court documents.

The other witness statements varied in terms of the individuals’ locations, the events leading up to the shooting, and correctly identifying Mulkey from a lineup of photographs.

After interviewing all the witnesses, detectives finally met with Mulkey. However, as soon as an investigator introduced themselves, Mulkey requested legal representation. Consequently, he was taken into custody and is currently being held without bond at Marion County jail.

In addition to the charges related to the shooting, online jail records indicate that Mulkey is facing charges for two counts of battery resulting in bodily injury and domestic battery for an unrelated incident.

A jury trial has been scheduled for January 22nd to further address this case..
