HOUSTON, Texas (KTRK) — A man who was accused of impersonating a police officer during an alleged sexual assault outside of a Fourth Ward church had his charges dismissed after nearly two years, according to newly released documents.

Martin Hernandez, who was charged with sexual assault and impersonating a public servant in 2021, had his charges dropped after attorneys stated that there was insufficient evidence to support the allegations against him.

The case first gained attention when a woman came forward on July 26, 2021, claiming that she had been pulled over by a man posing as a Houston Police Department officer in a fake patrol vehicle. The woman alleged that the man accused her of being intoxicated and forced her into the backseat of his car, where he sexually assaulted her.

The incident occurred outside the Mt. Horeb Missionary Baptist Church, and the woman reported that she later discovered the man was actually a security guard employed by the church. The woman’s account was supported by charging documents, which revealed that Hernandez’s DNA matched a swab taken from the victim.

However, after a thorough review of the evidence, attorneys determined that there was no probable cause to believe Hernandez committed the offenses. As a result, the charges against him were dropped.

The dismissal of the charges has raised questions about the initial investigation and the credibility of the victim’s account. Eyewitness News reached out to the Houston Police Department for further details regarding the alleged assault but has not yet received a response.
