17-Year-Old Peiyton A. Smith Faces Adult Court for Homicide of Demarion Black

The male juvenile accused of the June murder of 16-year-old Demarion Black has made his first appearance in adult court. Peiyton A. Smith, now 17 years old, appeared virtually on Tuesday, with his bond hearing rescheduled for Thursday.

Smith’s case is being presided over by Circuit Judge Jay Wethington, who granted the request of Evan Taylor, Smith’s attorney, to postpone the bond hearing.

Back in October, Smith was given a bond of $500,000 full cash. Alongside the murder charge, he is also facing charges of possessing a handgun as a minor and possessing marijuana (less than 8 ounces, first offense).

Although the bond hearing was moved to Thursday, court documents reveal that Taylor filed two motions on Tuesday. One of the motions is for a bond review, while the other seeks to suppress any statements or confessions made by Smith and the evidence obtained from those statements. Judge Wethington has yet to make a ruling on either motion.

According to Daviess County Attorney John Burlew, Smith was technically transferred to adult court in August. However, due to state law, the identity of the juvenile could not be disclosed until the first appearance in adult court.

The tragic shooting incident took place on June 24 at approximately 9:11 p.m. in the 1800 block of Hughes Avenue. Upon arrival at the scene, officers from the Owensboro Police Department discovered Demarion Black, a juvenile male, with multiple gunshot wounds, as stated in the release at the time. Black was immediately transported to Owensboro Health Regional Hospital, where he succumbed to his injuries.

The process of transferring a case from juvenile court to adult court follows the guidelines outlined in KRS 640.010.
