NORRISTOWN — Officer’s Use of Force Deemed Lawful in Fatal Shooting

An independent investigation conducted by Montgomery County’s district attorney’s office has concluded that an Upper Moreland Township police officer acted within the bounds of the law when he discharged his weapon, resulting in the death of a 69-year-old woman. District Attorney Kevin R. Steele announced the findings on Monday, bringing an end to the scrutiny surrounding the officer-involved shooting that occurred on October 8, 2023.

Investigation Supports Use of Deadly Force

The incident unfolded when emergency medical personnel and police responded to a distress call reporting a suicidal female potentially armed with a firearm. Upon arrival, paramedics encountered Mary Meister, who was standing at the front door of her residence brandishing a handgun. Meister proceeded to point the firearm directly at the EMTs, prompting them to quickly retreat and inform the arriving police officers of the threatening situation.

Recognizing the urgency of the circumstances, an Upper Moreland police officer attempted to negotiate with Meister for over 12 minutes, imploring her to drop the weapon and engage in a dialogue. Unfortunately, Meister adamantly refused to cooperate, maintaining her aggressive stance.

Officer’s Actions Justified

At this point, a Hatboro police officer arrived on the scene equipped with a less-lethal weapon, which fired rubber batons. The officer discharged four rounds, with one striking Meister in the leg. Despite being hit, Meister briefly inspected her leg before immediately raising her weapon and pointing it directly at the officers, as revealed during the subsequent investigation.

In response to the imminent threat posed by Meister, an Upper Moreland police officer made the split-second decision to protect himself and his fellow officers. He discharged his weapon, causing Meister to fall to the ground. Immediate medical assistance was provided, and Meister was rushed to Abington Memorial Hospital. Regrettably, she was pronounced dead at 5:48 p.m.

Firearm and Suicide Note Recovered

Detectives discovered a silver Smith & Wesson .38-caliber revolver lying next to Meister’s lifeless body. It was determined that Meister had purchased the firearm on August 25, 2023. Further investigation led to the discovery of a handwritten note inside Meister’s residence, indicating her intention to commit suicide.

Legal Justification for Use of Deadly Force

In Pennsylvania, the use of deadly force by law enforcement officers is governed by Section 508 of the Pennsylvania Crimes Code. According to this legislation, officers are justified in using deadly force if they believe it is necessary to prevent death or serious bodily harm to themselves or others. Additionally, officers can use deadly force to apprehend individuals who possess a deadly weapon or demonstrate an intent to harm others.
