Famed forensic scientist Henry Lee is facing severe backlash after a federal judge found him liable in a lawsuit for fabricating evidence in a murder trial, leading to the wrongful conviction of two innocent men. Ralph “Ricky” Birch and Shawn Henning were convicted in 1985 for the murder of Everett Carr based partially on Lee’s testimony about bloodstains found on a towel in the victim’s home.

However, a judge vacated their convictions in 2020, and subsequent tests revealed that the stain on the towel was not blood. U.S. District Court Judge Victor Bolden ruled last week that there was no evidence to suggest that Lee ever conducted any blood tests on the towel, leaving him liable for the fabrication of evidence.

In response to the ruling, Lee defended himself, denying any wrongdoing and suggesting that the traces of blood may have degraded over the 20-year period between the crime and when the defense tested the towel. He also claimed that his testing played no direct role in implicating Birch and Henning as suspects and that he provided exculpatory evidence during their trial.
